Case Study 2

GlaxoSmithKline (GSK) is one of the world's largest pharmaceutical companies, with an annual turnover in excess of $40bn.

We advised them on the establishment of their $100m R&D centre in Shanghai, China – one of the first and largest projects of its kind undertaken in the area. Simmons & Simmons won the work in a competitive tender process involving over 60 law firms.

We provided GSK with advice spanning a wide range of topics on this complex project, which involved much cross-practice work and collaboration between teams based in Hong Kong and Shanghai. These included: project/foreign investment approvals; preferential treatment for R&D centres; environmental, planning and construction; obtaining operating permits; IP ownership; patent filing strategy for inventions made in China and technology transfer; employment issues; employee remuneration scheme for inventions; dispute resolution; competition law issues; collaboration and outsourcing agreements.
